Accessibility Strengthening Act 2025: Mandatory Standards for Websites
The German Accessibility Strengthening Act (Barrierefreiheitsstärkungsgesetz – BFSG) will take full effect on June 28, 2025. This legislation marks a significant shift as it extends accessibility requirements from public authorities to the private sector. It is the national implementation of the European Accessibility Act (EAA).
Scope of the BFSG
The law applies to a wide range of digital services provided to consumers. Affected businesses include:
- Online retailers and e-commerce stores.
- Banking and financial service providers.
- Electronic communication services.
- Transport service websites (air, bus, rail).
- Media services and e-books.
Micro-enterprises with fewer than 10 employees and an annual turnover of less than 2 million euros are generally exempt from these requirements.
Technical Compliance and WCAG Standards
To meet legal requirements, websites must adhere to the EN 301 549 standard, which aligns with WCAG 2.1 Level AA. The implementation focuses on four key areas:
- Perceivability: Information must be presented in ways users can perceive, such as providing text alternatives for non-text content.
- Operability: All user interface components must be navigable via keyboard.
- Understandability: Users must be able to understand the information and the operation of the interface.
- Robustness: Content must remain accessible as technologies and user agents evolve, ensuring compatibility with screen readers.
Risks of Non-Compliance
Failure to comply by the deadline of June 2025 can lead to severe penalties. Regulatory authorities have the power to issue warnings, ban the provision of services, and impose fines of up to 100,000 euros.
